Spain is one of the larger EU consumer markets, and it has had active packaging EPR enforcement since the late 1990s. ECOEMBES — the Ecoembalajes España consortium — manages household packaging take-back for the vast majority of the Spanish market, covering over 14,000 member companies. If your clients sell packaged goods to Spanish consumers, they need to be ECOEMBES members and submit annual packaging declarations. Those declarations require your BOM data.
ECOEMBES: Spain's packaging PRO
ECOEMBES (Ecoembalajes España, S.A.) operates under Spain's packaging legislation, which predates the EU PPWR and has been continuously updated to align with EU requirements. It runs the Punto Verde (Green Dot) system, managing the collection and recycling of household packaging across all Spanish municipalities.
Membership is required for any company that sells packaged goods to Spanish consumers — including foreign brands. The membership fee (eco-contribution) is calculated based on the quantity and material type of packaging placed on the Spanish market in the previous year.
Spain also has a second system — Ecoembalajes — for industrial and commercial packaging, though household packaging (your primary concern as a product packaging supplier) is covered by ECOEMBES.
Spain's material categories and what they mean for your BOM
ECOEMBES uses material categories broadly aligned with the EU standard, but with some specifics that affect how you should classify components in your BOM:

Spain's fee structure and the lightweight packaging effect
Spain's eco-contribution rates per kilogram are among the lowest in major EU markets for most material categories. However, this does not mean the total cost is low — Spain has significant plastic packaging volumes, and the fee per kg for plastics is higher than for paper/board.
One practical implication for suppliers: because ECOEMBES fees are calculated strictly on weight declared, and Spain's enforcement has historically been less aggressive than Germany's or France's, some brands have been tempted to underestimate packaging weights. This is changing — ECOEMBES has been tightening audits since 2023, and PPWR harmonization will bring Spanish enforcement to the same level as northern EU markets.
Provide accurate weights. Even in Spain, inaccurate declarations carry legal and financial risk that ultimately traces back to the supplier data.
E-commerce packaging in Spain
Spain has been updating its packaging legislation to explicitly address e-commerce packaging — the boxes and protective materials used to ship directly to consumers. Under current Spanish law and PPWR alignment:
- Shipping boxes sent to Spanish consumers are Verkaufsverpackungen equivalent — they must be declared by your client
- Void fill materials (kraft paper, bubble wrap, crumpled paper) are packaging and must be included in the BOM
- Polybags used to protect products inside the shipping box are primary packaging — include them separately from the outer box
For clients who ship direct-to-consumer in Spain, the full e-commerce packaging stack — product box, inner protection, mailer/shipper — must be in the BOM. Incomplete BOMs that omit e-commerce components create declaration gaps.
The extended producer responsibility for industrial packaging
If you supply packaging components to brands via B2B shipments (pallets, bulk containers, grouped outer cartons), Spain distinguishes this as "envases industriales y comerciales" (industrial and commercial packaging), which falls under a separate obligation managed by Ecoembalajes rather than ECOEMBES.
For most product packaging suppliers, this distinction is not directly relevant — your BOM data covers the product packaging that reaches consumers. But if you supply packaging components in large transport formats (pallet quantities, shrink-wrapped bulk), your B2B client may have a separate declaration obligation for that transport packaging.
Timeline: when your Spanish clients will ask for data
ECOEMBES declarations cover the previous calendar year. The typical timeline:
- Declarations are due in Q1 (February–March) for the previous year
- Eco-contributions are invoiced quarterly in arrears (January, April, July, October), based on provisional estimates corrected by annual declaration
- Some clients also request mid-year data updates if their Spanish volumes have changed significantly
Expect Spanish packaging data requests to peak in December–February. If you have structured BOM data ready in advance, responding takes minutes rather than days.
Practical summary for Spanish client requests
- Provide material category at the ECOEMBES level — paper/cardboard, plastic (with polymer type), glass, ferrous metal, aluminium, wood, composite
- Specify polymer type for all plastics — Spain is introducing eco-modulation criteria that will require this
- Include all e-commerce packaging components — shipping box, void fill, polybags, labels
- Use per-unit weights — ECOEMBES calculates on units sold, not pallets
- Keep versions dated — Spanish clients may need to distinguish packaging from different periods for their annual declaration
